1. Introduction and Acceptance of Terms
1.1 Welcome to HabitScript, a habit tracking, goal-setting, and productivity application provided by PRIMEPEAK INC. ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the HabitScript application ("Service"), available on iOS, as well as through our website at primepeak.io (the "Site").
1.2 By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Service. Your continued use of the Service constitutes acceptance of these Terms.

1.4.3 Previous Product Name: HabitScript was previously published as GoalScript. These Terms supersede any terms of service previously published for GoalScript and apply to your use of the Service under either name.
1.5 Brief Summary of the Service
HabitScript is a local-first habit tracking and goal-setting application designed to help users transform their aspirations into achievable daily actions. Our Service includes tools for goal management, habit tracking, task organization, progress tracking, daily activity scoring, streaks, and curated multi-week programs. All user data - including goals, habits, tasks, entries, and progress - is stored locally on your device. No account creation or sign-in is required to use the Service.
2. Eligibility and Age Restriction
2.1 Eligibility
To use the Service, you must be at least 13 years old. By using the Service, you confirm that you meet this age requirement.
2.2 Children's Guidelines
Our Service is not directed at children under 13, and we do not knowingly collect personal information from them. If we become aware of such data collection, we will delete the information. If you believe we may have inadvertently collected information from a child, please contact us at info@primepeak.io.
3. Privacy and Data Collection
3.1 Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect your data. This policy is compliant with GDPR, CCPA, and other international privacy laws and is available at primepeak.io/products/habitscript/privacy.
3.2 Local-First Data Storage
HabitScript operates on a local-first architecture. All user-created content - including goals, habits, tasks, progress entries, and activity data - is stored on your device. We do not maintain server-side databases or accounts for storing your personal productivity data. You are solely responsible for the data stored on your device, including maintaining backups. For premium subscribers, the Service can additionally sync your data to your personal Apple iCloud account so it is available across your devices and after reinstalling the app. This data is stored under your own Apple ID - PRIMEPEAK INC. has no access to it and operates no servers of its own. A small anonymous app-settings file may sync via iCloud for all users to support continuity across reinstalls.
3.3 Third-Party Services
We use the following third-party services for limited operational purposes:
3.3.1 RevenueCat (revenuecat.com): Subscription management for in-app purchases made through the App Store. RevenueCat identifies your device using an anonymous local identifier - no personal account information is required.
3.3.2 Mixpanel (mixpanel.com), PostHog (posthog.com), and Vercel Analytics (vercel.com/docs/analytics): Anonymous usage analytics to help us improve the Service.
3.3.3 Sentry (sentry.io): Error tracking and performance monitoring to improve app stability.
3.3.4 Expo Application Services (EAS) (expo.dev/eas): Development and deployment for mobile applications.
3.3.5 Vercel (vercel.com): Hosting and deploying our website at primepeak.io.
3.3.6 Apple App Store (apple.com): App distribution and processing of all purchases and subscription billing.

4. No Account Required
4.1 HabitScript does not require account creation, registration, or sign-in. The Service operates without user accounts, and no personal credentials are stored on our servers. Your data resides on your device (and, for premium subscribers, in your personal iCloud account).
4.2 Because all data is stored locally, you are responsible for the security of your device and the data stored on it. PRIMEPEAK INC. is not responsible for any data loss resulting from device loss, damage, or unauthorized access to your device.
5. Data Retention and Deletion for Legacy Versions
5.1 Applicability
This section applies to users who access or have accessed the Service through app versions prior to 4.0, which utilized an authentication-based flow requiring account creation and server-side data storage ("Legacy Versions").
5.2 Legacy Data Storage
Unlike the current local-first architecture (version 4.0 and above), Legacy Versions stored user-created content - including goals, habits, tasks, progress entries, and activity data - on our servers in association with your account.
5.3 Inactive Account Data Deletion
If you are using a Legacy Version and have not opened or accessed the Service for a continuous period of ninety (90) days, as determined by the last recorded app activity timestamp, PRIMEPEAK INC. reserves the right to permanently delete all data associated with your account from our servers. This deletion is performed as part of our ongoing data cleanup and security initiatives.
5.4 Deletion Is Permanent
Once your data has been deleted under this policy, it cannot be recovered. PRIMEPEAK INC. shall not be liable for any loss of data resulting from deletion carried out in accordance with this section.
5.5 Recommendation to Upgrade
We strongly encourage all users on Legacy Versions to upgrade to the current version, which operates on a local-first architecture and does not rely on server-side data storage. By upgrading, your data is stored exclusively on your device and is not subject to this data retention policy.
6. Subscription and Payment Terms
6.1 Freemium Model
HabitScript offers both free and premium features. Premium features are available through paid plans, and current pricing is displayed within the app at the time of purchase.
6.2 Payment Processing
All payments are processed by Apple through the App Store and managed with RevenueCat (revenuecat.com). We do not handle or store your payment information. All applicable fees are displayed at the time of purchase.
6.3 Automatic Renewal
Subscription plans renew automatically at the end of each billing period unless canceled at least 24 hours before the renewal date. You authorize charges to your payment method for the recurring fees at the then-current rate. You can manage or cancel your subscription at any time through your App Store account settings.
6.4 Apple Standard EULA
Your use of the Service is also subject to Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula, to the extent it applies to applications distributed through the App Store.
7. Subscription Information and Refund Policy
7.1 Subscription Information
Subscriptions are personal, non-transferable, and tied to your device and app store account. Premium features are unlocked on the device where the subscription is active.
7.2 Refund Policy
Purchases are processed by Apple and are subject to Apple's refund policies. Refunds are generally not provided by us, except in cases of technical issues attributable to us or as required by applicable law. To request a refund, contact Apple Support or reach out to us at info@primepeak.io.
8. Acceptable Use of the Service
8.1 You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others or disrupt the Service.
8.2 Prohibited activities include, but are not limited to:
8.2.1 Violating any applicable laws or regulations.
8.2.2 Engaging in unauthorized access to other accounts or systems.
8.2.3 Distributing viruses, malware, or harmful software.
8.2.4 Interfering with the integrity, security, or functionality of the Service.
8.3 Violations may result in the restriction or termination of your access to the Service and may be subject to civil and criminal liability.
9. Security Rules
9.1 You are prohibited from attempting to compromise the security of the Service, including unauthorized access, testing vulnerabilities, or circumventing security measures. PRIMEPEAK INC. reserves the right to investigate and prosecute violations to the fullest extent of the law.
10. User Content and Ownership
10.1 You Own Your Content
You retain all rights to the content you create in the Service, including your goals, habits, tasks, progress entries, notes, and activity data. We claim no ownership over your content.
10.2 Your Responsibility
Because your content is stored on your device (and, if you enable premium sync, in your own iCloud account), you are responsible for maintaining it, including creating backups before changing, resetting, or disposing of a device.
11. Intellectual Property Rights
11.1 All content, features, and functionality within HabitScript, including text, graphics, logos, icons, images, and software, are the exclusive property of PRIMEPEAK INC. or its licensors and are protected by international copyright, trademark, and other intellectual property laws.
11.2 License and Restrictions
PRIMEPEAK INC. grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use only. Unauthorized use or duplication of materials is strictly prohibited.
11.3 Content Disclaimer
HabitScript is a self-tracking and personal productivity tool. The habits, goals, streaks, activity scores, programs, and other guidance presented in the Service are provided for general informational and motivational purposes only. They do not constitute medical, psychological, mental health, fitness, or professional advice, and they are not a substitute for consultation with a qualified professional. The Service does not diagnose, treat, or monitor any health condition. You are solely responsible for deciding which habits and goals to pursue and for evaluating whether they are appropriate and safe for you. If you have a medical or mental health condition, or are considering a change that could affect your health, consult a qualified healthcare professional before acting.
11.4 Trademarks
The names "HabitScript," "GoalScript," and "PRIMEPEAK INC." and all related logos and taglines are trademarks of PRIMEPEAK INC. You may not use these trademarks without our prior written consent.
12. Service Availability and Modifications
12.1 We may modify, suspend, or discontinue any part of the Service at any time, including features, functionality, or availability of premium plans.
12.2 We will make reasonable efforts to provide notice of significant changes through in-app notifications or App Store update descriptions.
12.3 We are not liable for any unavailability of the Service caused by events beyond our reasonable control, including acts of God, network failures, or actions by third-party providers such as Apple.
13. Termination
13.1 Termination by You
You may stop using the Service at any time by deleting the app from your device. Deleting the app removes your locally stored data. If you enabled iCloud sync, you can additionally remove HabitScript's iCloud data in iOS Settings under your Apple ID > iCloud. Subscriptions must be canceled separately through your App Store account settings.
13.2 Termination by Us
We may restrict or terminate your access to the Service if you violate these Terms or use the Service in a manner that is unlawful or harmful to others.
14. Indemnification
14.1 You agree to indemnify, defend, and hold harmless PRIMEPEAK INC., its affiliates, and their employees from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or any infringement of rights by you or any third party.
15. Limitations of Liability and Release
15.1 To the fullest extent permitted by law, PRIMEPEAK INC. and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Service.
15.2 Aggregate Liability Cap. To the fullest extent permitted by applicable law, PRIMEPEAK INC.'s total cumulative liability to you for all claims arising out of or related to these Terms or the Service - whether in contract, tort (including negligence), strict liability, or any other legal theory - shall not exceed the greater of (a) the total amounts you have paid to PRIMEPEAK INC. for use of the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) ten Canadian dollars (CAD $10.00).
15.3 PRIMEPEAK INC. is not responsible for any content, actions, or omissions of third parties involved in delivering the Service or supporting related functionality.
15.4 In jurisdictions that do not allow limitations of liability for certain damages, PRIMEPEAK INC.'s liability shall be limited to the maximum extent permitted by law.
16. Warranties
16.1 The Service is provided "as-is" and "as available." PRIMEPEAK INC. makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Service for your needs.
16.2 PRIMEPEAK INC. disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement to the fullest extent permitted by law.
17. International Users and Privacy Compliance
17.1 The Service is available worldwide through the Apple App Store. We comply with applicable privacy laws in the jurisdictions where we operate.
17.2 You are responsible for compliance with any local laws applicable to your use of the Service.
18. Assignment
18.1 You may not assign or transfer these Terms or any rights under them. PRIMEPEAK INC. may assign these Terms in connection with a merger, acquisition, or sale of assets.
19. General Provisions
19.1 Entire Agreement
These Terms constitute the entire agreement between you and PRIMEPEAK INC. regarding your use of the Service and supersede any prior agreements, including any terms previously published under the GoalScript name.
19.2 Governing Law and Jurisdiction
These Terms are governed by the laws of Ontario, Canada. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, ON, Canada, for any disputes arising from these Terms or the Service.
19.3 Informal Resolution First
Before filing a claim, you agree to contact us at info@primepeak.io so we can attempt to resolve the matter informally.
19.4 Severability
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
19.5 Waiver
The failure of PRIMEPEAK INC. to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
19.6 Language
These Terms are drafted in English. Any translation is provided for convenience only, and the English version governs in the event of a conflict.
