1.1 Welcome to Faithful - Daily Prayer Journal, a mobile application provided by PRIMEPEAK INC. ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Faithful - Daily Prayer Journal application ("Service"), available on iOS as well as through our website at primepeak.io (the "Site").

1.2 By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Service. Your continued use of the Service constitutes acceptance of these Terms.

Faithful - Daily Prayer Journal is a mobile application designed to help users deepen their faith through daily prayer journaling, reflection, and spiritual growth.

2. Eligibility and Age Restriction

2.1 Eligibility

To use the Service, you must be at least 13 years old. By using the Service, you confirm that you meet this age requirement.

2.2 Children's Guidelines

Our Service is not directed at children under 13, and we do not knowingly collect personal information from them. If we become aware of such data collection, we will delete the information. If you believe we may have inadvertently collected information from a child, please contact us at info@primepeak.io.

3. Privacy and Data Collection

3.1 Privacy Commitment

Your privacy is important to us. This section explains how we collect, use, share, and protect your data in compliance with GDPR, CCPA, and other international privacy laws.

3.2 Data We Do NOT Collect

We do not collect, store, or have access to:

  • Personal identifying information (names, emails, phone numbers, addresses)

  • User account credentials or passwords

  • Personal content (your prayer journal entries, notes, favorite prayers, or preferences)

  • Location data or device contacts

  • Any data that can personally identify you

    3.3 Data We DO Collect

We collect only the following anonymous data to improve our service:

3.3.1 Analytics Data: Anonymous usage statistics (which features you use, when you use the app) via Mixpanel to help us understand how to improve the app.

3.3.2 Error Reports: Anonymous crash logs and error reports via Sentry to help us fix bugs and improve app stability.

3.3.3 Device Information: Random UUID assigned to your app installation, device type (iPhone/iPad), and app version for analytics purposes only.

3.3.4 Payment Information: If you choose to support us, payment processing is handled entirely by Apple App Store and RevenueCat. We only receive confirmation that a subscription was purchased, but no payment details.

3.4 How We Use Your Data

We use the anonymous data we collect to:

  • Improve app performance and fix bugs

  • Understand which features are most valuable to users

  • Ensure the app works properly across different devices

  • Monitor for technical issues

    3.5 Data Sharing

We do not sell, rent, or share your data with third parties for marketing purposes. We only share anonymous data with:

  • Apple: As required for App Store distribution

  • Our service providers: Mixpanel (analytics), Sentry (error tracking), and RevenueCat (payment processing) - all bound by privacy agreements

    3.6 Your Rights

Since we don't collect personal data that can identify you:

  • There is no personal data to access, modify, or delete from our servers

  • Your personal content (prayer journal entries, notes, favorites) stays on your device and, when iCloud sync is available, automatically syncs to your personal iCloud account

  • You can stop all data collection by deleting the app

    3.7 Children's Privacy

We do not knowingly collect any data from children under 13. If you believe we have inadvertently collected such information, please contact us immediately at info@primepeak.io.

3.8 International Data Transfers

The anonymous data we collect may be processed by our service providers in various countries. All transfers are conducted in accordance with applicable privacy laws.

3.9 Data Retention

Anonymous analytics data is retained only as long as necessary for the purposes outlined above, typically no longer than 2 years. You can stop all data collection at any time by deleting the app.

3.10 Core Infrastructure and Third-Party Services

We use the following core infrastructure and third-party services for various operational purposes:

3.2.1 RevenueCat (revenuecat.com): Payment processing for in-app subscriptions and purchases.

3.2.2 Mixpanel (mixpanel.com) and Vercel Analytics (vercel.com/docs/analytics): Usage analytics and user behavior tracking.

3.2.3 Sentry (sentry.io): Error tracking and performance monitoring.

3.2.4 Expo Application Services (EAS) (expo.dev/eas): Development and deployment for mobile applications.

3.2.5 Vercel (vercel.com): Hosting and deploying the marketing website.

3.2.6 CDN (cdnjs.cloudflare.com): Content delivery for external scripts.

4. Account Registration and Data Storage

4.1 No Account Required

You do not need to create an account to use the Service. The Service is free to use and all user data (including prayer journal entries, notes, favorites, and preferences) is stored locally on your device.

4.2 Data Storage and Responsibility

All personal data, including your prayer journal entries, notes, favorite prayers, and app settings, are stored on your device. We do not store this information on our servers.

Automatic iCloud Sync: When iCloud sync is available for your account, your data automatically syncs to your personal iCloud account (managed by Apple). This allows seamless access across multiple devices signed into the same Apple ID. We do not have access to your iCloud data.

Export/Import: The app provides export and import functionality for backing up and transferring your data. You are responsible for the security of exported backup files.

Data Deletion: If you delete the app, local data on that device is permanently removed. If iCloud sync is active, your data remains in your iCloud account until you manually delete it via iOS Settings. We cannot recover deleted data under any circumstances.

4.3 Data Collection

We only collect anonymous usage analytics and error reports through our third-party services. We assign a random UUID to your app installation for analytics purposes, but this cannot be used to identify you personally and is not linked to any personal information.

5. Subscription and Payment Terms

5.1 Faithful - Daily Prayer Journal operates on a freemium model where the majority of features are available for free. Premium subscription plans provide access to additional features and support continued development of the app. Current pricing is displayed within the app at the time of purchase. Payments are securely processed by the Apple App Store and RevenueCat (revenuecat.com). All applicable fees are displayed at the time of purchase and are non-refundable unless required by law.

5.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the renewal date. You authorize us to charge your payment method for the recurring fees at the then-current subscription rate. You can manage your subscription settings through the Apple App Store.

5.3 Apple App Store Terms

Your use of the Service through the Apple App Store is also subject to Apple's End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

6. Membership Information and Refund Policy

6.1 Membership Information

Subscriptions are personal, non-transferable, and tied to your Apple account. Premium subscriptions unlock access to additional features beyond those available in the free version of the app.

6.2 Refund Policy

Refunds are generally not provided, except in cases of technical issues attributable to us or as required by applicable law. For App Store purchases, refund requests should be made directly through Apple. For other inquiries, please contact info@primepeak.io.

7. Acceptable Use of the Service

7.1 You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others or disrupt the Service.

7.2 Prohibited activities include, but are not limited to:

7.2.1 Violating any applicable laws or regulations.

7.2.2 Attempting unauthorized access to the app's systems or reverse engineering the application.

7.2.3 Using the Service to distribute harmful software or malicious content.

7.2.4 Interfering with the integrity, security, or functionality of the Service.

7.3 Violations may result in the suspension of your access to the Service and may be subject to civil and criminal liability.

8. Security Rules

8.1 You are prohibited from attempting to compromise the security of the Service, including unauthorized access, testing vulnerabilities, or circumventing authentication measures. PRIMEPEAK INC. reserves the right to investigate and prosecute violations to the fullest extent of the law.

9. User Content and Ownership

9.1 Your Content

You retain full ownership of any content you create within the app, including prayer journal entries, notes, favorites, and personal reflections. We do not claim any ownership rights to your personal content.

9.2 Data Storage

Your content is stored on your device. When iCloud sync is available for your account, your data automatically syncs to your personal iCloud account for seamless multi-device access. Your content is not transmitted to or stored on our servers. We cannot access, modify, or delete your personal content.

10. Intellectual Property Rights

10.1 All content, features, and functionality within Faithful - Daily Prayer Journal, including text, graphics, logos, icons, images, and software, are the exclusive property of PRIMEPEAK INC. or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

10.2 License and Restrictions

PRIMEPEAK INC. grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use only. Unauthorized use or duplication of materials is strictly prohibited.

10.3 Content Disclaimer

While we strive to provide meaningful content to support your spiritual journey, the app is provided for personal reflection and growth. The content is not intended as official religious guidance, instruction, or counseling. We recommend consulting with appropriate spiritual advisors or religious authorities for specific guidance.

11. Digital Millennium Copyright Act (DMCA)

11.1 We respect intellectual property rights and comply with the Digital Millennium Copyright Act. If you believe that content in our Service infringes your copyright, please contact us at info@primepeak.io with a detailed description of the alleged infringement.

12. Service Availability and Modifications

12.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also update these Terms from time to time.

12.2 Notice of Changes

When we make changes to these Terms, we will notify users through the app interface or other reasonable means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

12.3 Force Majeure

We shall not be liable for any failure or delay in performance of the Service due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or technical failures.

13. Assignment

13.1 We may assign or transfer these Terms and our rights and obligations hereunder to any third party without restriction. You may not assign or transfer your rights under these Terms without our prior written consent.

14. Termination

14.1 Termination by You

You may stop using the Service at any time by deleting the app from your device. Upon deletion, all locally stored data will be permanently removed.

14.2 Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice, if you violate these Terms or for any other reason at our sole discretion.

15. Indemnification

15.1 You agree to indemnify, defend, and hold harmless PRIMEPEAK INC., its affiliates, and their employees from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or any infringement of rights by you or any third party.

16. Limitations of Liability and Release

16.1 To the fullest extent permitted by law, PRIMEPEAK INC. and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Service.

16.2 PRIMEPEAK INC. is not responsible for any content, actions, or omissions of third parties involved in delivering the Service or supporting related functionality.

16.3 Liability Cap: To the fullest extent permitted by law, PRIMEPEAK INC.'s total cumulative liability to you for any and all claims arising from or related to the Service shall not exceed the total amount you have paid to PRIMEPEAK INC. for the Service during the twelve (12) months immediately preceding the event giving rise to the claim, or ten Canadian dollars (CAD $10), whichever is greater.

16.4 In jurisdictions that do not allow limitations of liability for certain damages, PRIMEPEAK INC.'s liability shall be limited to the maximum extent permitted by law.

17. Warranties

17.1 The Service is provided "as-is" and "as available." PRIMEPEAK INC. makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Service for your needs.

17.2 PRIMEPEAK INC. disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement to the fullest extent permitted by law.

18. International Users and Privacy Compliance

18.1 Global Availability

The Service is available worldwide through the Apple App Store. We comply with applicable privacy laws in the jurisdictions where we operate.

18.2 Data Processing

Our processing of anonymous analytics data is based on legitimate business interests in improving and maintaining the Service. Users in certain jurisdictions may have additional rights regarding their data as described in our Privacy Policy.

18.3 Local Laws

You are responsible for ensuring that your use of the Service complies with applicable local laws in your jurisdiction.

19. Dispute Resolution

19.1 Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

19.2 Jurisdiction

You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the courts of Toronto, Ontario, Canada.

19.3 Alternative Dispute Resolution

20. General Provisions

20.1 Entire Agreement

These Terms constitute the entire agreement between you and PRIMEPEAK INC. regarding your use of the Service and supersede any prior agreements.

20.2 Severability

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.

20.3 Waiver

The failure of PRIMEPEAK INC. to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

20.4 Language

These Terms are written in English. Any translations are provided for convenience only, and the English version shall prevail in case of any discrepancies.
